Consent and Violation Policy - Updated

At Casa Kink, consent is the foundation of our community and culture. We strive to create a space where everyone feels safe, respected, and able to express themselves authentically. To support this, we uphold clear consent principles and a consistent process for responding to safety concerns and consent violations.

Our approach is intentionally simple. This allows us to respond with care, consistency, and integrity, regardless of who is involved, including members of the Casa Kink team or leadership.

This is an update to our Consent and Violation Policy. Previous version can be found here.

The Essentials of Consent

Consent at Casa Kink is:

  • Personal Responsibility - Every individual is responsible for understanding and respecting boundaries, seeking clear consent, and communicating their own limits openly.

  • Informed - All activities require a mutual, informed agreement.

  • Authentic - Silence, uncertainty, or lack of resistance does not constitute consent.

  • Ongoing - Consent can be withdrawn at any time, for any reason.

  • Specific - Consent for one activity, context, or person does not imply consent for others.

Reporting a Consent or Safety Concern

We take all reports of consent violations and safety concerns seriously. If you experience or witness a breach of consent, you are encouraged to speak to the Casa Kink owner, Manager or a Consent Monitor. If you do not feel comfortable doing so at the time, you may report later by:

Reports can be made whether or not you are certain something was “serious enough.” If something felt off, we want to hear about it.

What Happens After a Report Is Made

When a report is received:

  • Nita (owner) or a Consent Monitor will listen, document the report, and clarify what support the reporting person would like.

  • Immediate safety needs of the reporting person are prioritised.

  • The reporting person is never required to confront the reported individual.

  • Information is shared only with those who need to know in order to manage community safety.

  • Casa Kink determines appropriate next steps based on the nature of the report, past patterns of behaviour, and potential risk to our collective.

The Casa Kink owner maintains strictly confidential internal records of reports and safety concerns. These records do not hold identifying information and as such are maintained in compliance with POPIA. These records exist to identify patterns over time and to support appropriate, proportionate responses. They are used solely for community safety purposes.

Casa Kink’s Role in Handling Reports

Casa Kink does not conduct formal investigations or determine legal guilt. That role belongs to law enforcement and the justice system.

However, Casa Kink does assess reports in order to make safety decisions. Our focus is on risk, patterns of behaviour, and impact, rather than proof beyond doubt.

We believe survivors and recognise that reporting harm takes courage. Our responsibility is to act with care, consistency, and integrity, even when situations are complex or uncomfortable.

Responses to Consent Violations

Responses are based on the nature, severity, and context of the reported behaviour, as well as any relevant history.

  • Education and Conversations - For minor misunderstandings or unintentional boundary crossings, the individual may be asked to meet with a Consent Monitor to reflect on consent practices and expectations. Education is used only where there is no indication of coercion, predatory behaviour, or repeated violations.

  • Observation (Watch List) - In cases of moderate concern or emerging patterns, an individual may be placed on a watch list. They may continue attending Casa Kink events, but Consent Monitors will be aware of prior concerns and will actively observe interactions.

  • Banning or Exclusion - Severe or repeated violations may result in exclusion from Casa Kink spaces. In some cases, individuals who are banned may still be permitted to attend specific educational or training sessions, such as consent education, as part of a longer-term accountability process.

Accountability is not a single conversation or consequence. Continued access to Casa Kink spaces may be conditional on demonstrated changes in behaviour over time.

Reports Involving Casa Kink Team Members or the Owner

Casa Kink recognises that reports involving Consent Monitors, Management, educators, or the owner carry additional power dynamics and risks.

In these cases, additional safeguards apply:

  • The reported individual will immediately step back from education/facilitation, or decision-making related community safety. They will not be involved in receiving, discussing, or responding to the report.

  • Where appropriate the reported person may be required to step away from some/all of their responsibilities at Casa Kink.

  • The same response framework applies regardless of role or seniority, including temporary withdrawal from the space or longer-term exclusion.

In cases involving the owner, accountability focuses on limiting access to power, influence, and discretionary community-facing roles rather than ownership of the business. The owner may step back from facilitation, hosting, or social participation at events, and will not be involved in receiving reports, making safety decisions, or determining outcomes related to the concern.

Operational and business responsibilities may continue where necessary to maintain the functioning of Casa Kink, while community safety decisions are handled by the manager in consultation with Consent Monitors. Where appropriate, Casa Kink may involve a trusted external advisor to support accountability, transparency, and process integrity in cases involving leadership.

Our Commitment

Accountability in small communities looks different than in large institutions. Casa Kink is committed to naming these limits honestly and acting with integrity within them.

Our policies are designed to prioritise the well-being of the collective, while offering pathways for learning and growth where appropriate. We aim to foster an environment of mutual respect, care, accountability, and inclusivity, where everyone can thrive.

Thank you for being part of our shared effort to uphold these values and keep Casa Kink a safer, more intentional space for all.
