Our Safety Policy & Processes

Casa Kink does not conduct formal investigations to determine legal guilt. That role belongs to law enforcement and the justice system.

What Casa Kink does is assess reports to make safety decisions for our community. Our focus is on risk, patterns of behaviour and impact, working out the most likely explanation for what happened from the evidence available, rather than requiring proof beyond doubt. Where evidence is genuinely unclear, we say so rather than guess, and we err on the side of protecting the person who came forward and the collective, rather than waiting for certainty before we act.

For reports of rape, sexual assault, serious physical assault, or conduct presenting a comparable risk of serious harm, this works differently. Casa Kink is not a police service or a court, and doesn't have the mandate to determine whether a crime occurred. In these cases we accept the survivor's account as the basis for protecting the collective: they are not required to prove, defend or repeatedly recount what happened, and no internal investigation into the allegation is conducted. They will be believed, supported and treated with dignity. Exclusion follows immediately.

Our responsibility, in every case, is to act with care, consistency and integrity, even when situations are complex or uncomfortable.

Responses to Consent Violations

Responses are based on the nature, severity and context of the reported behaviour, any relevant history, and a check of whether the person's name has come up before, however minor a report seems on its own.

Not everything needs a formal process. A brief, in-the-moment conversation is often the right response to a first-time misunderstanding, and something can be shared and recorded without triggering an investigation if the person sharing it isn't asking for one. Where a fuller response is needed, options include:
 

• Education: where a knowledge gap is the primary issue and there's no indication of coercion, predatory behaviour, or repeated violations.

• Watch List: for moderate concern or an emerging pattern. The individual may continue attending; Consent Monitors are aware of the history and actively observe.

• Restrictions or Suspension: limiting access or participation, temporarily or pending specific conditions being met.

• Permanent Exclusion: for severe or repeated violations, or unmanageable ongoing risk. Someone excluded may, in some cases, still be permitted to attend specific educational sessions as part of a longer-term accountability process.

The guiding principle is the least restrictive response that genuinely addresses the risk. Accountability isn't a single conversation or consequence, restrictions carry a review date, and continued access to Casa Kink spaces may stay conditional on demonstrated change over time. A breach of any restriction is treated as connected to the original finding, not as a fresh, unrelated incident.

Reports Involving Casa Kink Team Members 

Casa Kink recognises that reports involving Consent Monitors, management, educators or the owner carry additional power dynamics and risk. In these cases:

• The reported individual immediately steps back from education, facilitation, or any decision-making related to community safety, and is not involved in receiving, discussing or responding to the report.

• The matter is handed to an independent person, consistent with our conflict-of-interest process — familiarity or influence within a community this size doesn't disqualify someone by default, but a reasonable question over their independence does.

• Where appropriate, the person may be required to step away from some or all of their responsibilities at Casa Kink.

• The same response framework applies regardless of role or seniority, including temporary withdrawal or longer-term exclusion.

In cases involving the owner, accountability focuses on limiting access to power, influence and discretionary community-facing roles, rather than ownership of the business. The owner may step back from facilitation or social participation at events, and is not involved in receiving reports, making safety decisions, or determining outcomes related to the concern. Operational and business responsibilities may continue where necessary to keep Casa Kink running, while community safety decisions sit with the Safety Committee. Where appropriate, Casa Kink may bring in a trusted external advisor to support accountability, transparency and process integrity in cases involving leadership.

Our Commitment

Accountability in small communities looks different than in large institutions. Casa Kink is committed to naming these limits honestly and acting with integrity within them.
